Terms, Conditions & Platform Disclaimer

All users (buyers and sellers) must agree to these terms before using SkydiveDZ

1. Acceptance of Terms

By accessing and using SkydiveDZ, you accept and agree to be bound by these terms and conditions. If you do not agree to these terms, please do not use our platform.

2. Platform Overview

SkydiveDZ is a marketplace for buying and selling skydiving equipment. We provide tools to facilitate transactions between buyers and sellers but are not directly involved in the sale itself.

3. User Requirements

  • You must be at least 18 years old to use this platform
  • You must provide accurate and complete information in your profile and listings
  • You are responsible for maintaining the security of your account
  • You must not engage in fraudulent or illegal activities

4. Seller Obligations

  • All listed items must be skydiving-related equipment
  • Product descriptions must be accurate and complete
  • Photos must accurately represent the actual item
  • You must disclose any defects or issues with the equipment
  • You are responsible for shipping items promptly and securely
  • You must respond to buyer inquiries and disputes within 6 days

5. Fees and Payments

A 12.5% platform fee applies to all successful sales. This fee is automatically deducted from the seller's proceeds. Additional promotional fees may apply for featured listings.

Payments are processed through secure third-party providers. You agree to comply with their terms and conditions.

6. Tax Obligations

Both buyers and sellers are responsible for understanding and complying with their own tax obligations related to transactions on this platform.

  • Sellers are responsible for reporting income from sales and paying applicable taxes
  • Buyers may be responsible for use tax or sales tax depending on their jurisdiction
  • SkydiveDZ does not provide tax advice and is not responsible for users' tax compliance
  • Users should consult with tax professionals regarding their specific obligations

7. Shipping Protection

We offer a shipping protection program to ensure safe transactions. Payments are held in escrow until the buyer confirms delivery and satisfaction with the item. Buyers have 7 days from shipment to confirm or dispute.

8. CRITICAL PLATFORM DISCLAIMER

A. Marketplace Nature

SkydiveDZ is a marketplace platform only. We facilitate connections between independent buyers and sellers.

B. No Liability Without Shipping Protection

IMPORTANT: If buyer chooses NOT to purchase the optional Shipping Protection Package:

  • SkydiveDZ assumes ZERO LIABILITY for theft, damage, loss, or any issues with the transaction
  • Payment will be transferred to the seller according to the escrow timeline, regardless of any disputes
  • SkydiveDZ acts solely as a marketplace connecting buyers and sellers. While we facilitate transactions and provide marketplace services, we are not the seller of listed items. Our liability is limited to the maximum extent permitted by applicable law
  • Refund requests and marketplace disputes are handled in accordance with SkydiveDZ's Buyer Protection Policy and these Terms. Nothing in these Terms limits a customer's right to contact their card issuer or exercise any rights available under applicable law or card network rules

C. With Shipping Protection Package

If you purchase the optional Shipping Protection Package, you receive:

  • Access to dispute resolution services
  • Escrow protection with review period
  • Platform mediation for transaction issues
  • Coverage as outlined in the Shipping Protection terms

D. Equipment Safety

  • SkydiveDZ does NOT inspect or certify any equipment listed on the platform
  • Users are solely responsible for inspecting and verifying equipment safety and condition
  • Always have equipment inspected by a certified rigger before use
  • Using second-hand skydiving equipment carries inherent risks

E. User Responsibility

By using SkydiveDZ, you acknowledge that transactions are between you and other users. You accept full responsibility for:

  • Inspecting items upon receipt
  • Ensuring equipment meets safety standards
  • All risks associated with purchasing used skydiving equipment

⚠️ Shipping Protection is an optional service that provides additional coverage for eligible shipments. Choosing not to purchase Shipping Protection does not affect a customer's rights under applicable law or card network rules. SkydiveDZ's responsibilities and liability remain subject to these Terms and Conditions.

9. Dispute Resolution

In case of disputes between buyers and sellers, our platform provides a dispute resolution center. We will mediate disputes fairly, but we do not guarantee specific outcomes. Our decision is final.

Seller Response Requirement

If a dispute is filed against a seller, the seller must respond within 6 days of the dispute being opened.

Failure to respond: If the seller fails to respond within 6 days, the disputed item must be shipped to our Mediation facility for inspection. The item will be held until the seller has paid all return shipping fees and any associated costs. The buyer will receive a full refund during this period.

10. Prohibited Conduct

  • Posting false or misleading information
  • Engaging in fraudulent transactions
  • Harassing or threatening other users
  • Attempting to circumvent platform fees
  • Listing counterfeit or stolen equipment

11. Limitation of Liability

SkydiveDZ is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of the platform. We are not responsible for the quality, safety, or legality of items listed, the truth or accuracy of listings, or the ability of sellers to complete sales.

12. Safety Disclaimer

Skydiving equipment is inherently dangerous. Users are responsible for ensuring all equipment meets safety standards and is properly maintained. Always have equipment inspected by a qualified rigger before use. SkydiveDZ assumes no responsibility for equipment safety or fitness for use.

13. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of the platform constitutes acceptance of the modified terms.
